Allergan Protect the Botox Trademark Name

L’Oreal were  stopped by the EU trademark office when registering the right of the word  “botolist” and “botocyl” and recently the European Courts have backed the ruling to prevent L’Oreal registering the these words.

The EU Court of Justice backed earlier refusals by the EU trademark office for L’Oreal to own the rights to the words“botolist” and “botocyl” for cosmetic products.

Allergan Inc have always defended their brand name botulinum toxin type a, Botox which is the most established and very widely used cosmetic and medical product. Recently new products have entered the market and Allergan are trying to protect the Botox brand name.

The court statement

“The use of the marks at issue would take unfair advantage of the reputation of the ‘Botox’ trademarks,” according to a court statement today.

A spoke person for Allergan said.

“This court ruling reinforces Allergan’s position that the Botox name should only be used in relation to the Allergan product”

L’Oreal have introduced their own botulinum toxin called Azzalure which is in direct competition with Allergan’s Botox.

Many of us will remember Hoover the vacuum cleaner manufacturer and how brand awareness was affected by trademark name usage and their brand becoming a generic word for any vacuum cleaner.

In summary defining the market means does the market care for beauty at all or is it a very conservative rural market. The beauty statistics for your local market is also helpful in assessing the lifestyle choices of the market.

On completion of the botox training course can I get BOTOX from any Pharmacy?

No not all pharmacies supply BOTOX a list of Botox suppliers can be found in the KT Training members forum.

Doctors, Dentsist and Nurse prescribers can purchase the brand name BOTOX product directly from Allergan. Certificate of attendance of a recognised Allergan BOTOX training course may be requested. Alternatively medical professionals can buy their Botox from selected pharmacies, this will require a private prescription for the named patient again botox training certification may be requested.

Will I have to pay more for BOTOX from the pharmacy?

No
Prices will vary with some pharmacies offering deals, as prescriptions are VAT exempt this can save 20% on your product costs when purchasing from the pharmacy on prescription. There has been talk of HMRC reviewing VAT on cosmetic treatments, please check HMRC guidelines for current information regarding cosmetic clinics and VAT on cosmetic products and services.

BOTOX is a prescription only medicine and MRHA guidelines must be followed regarding the supply, storage and administration of POMs.

Why is it necessary to plan your business model before you start your medical aesthetic clinic.

When you enter the commercial world of medical aesthetics you are not competing with just yourself. You are competing with larger and smarter companies than yourself who are prepared to out perform you to attract the limited private patient market. Firstly I must point out the units and dilutions are not transferable between the various different botulinum toxin products.

There are many differences between the botulinum toxin products available on the market especially with Azzalure and Botox. Azzalure is provided in 125 Speywood unit vials and Botox is provided in 100 unit vials and Vistabel in 50 unit vials other differences include pharmacology, lethal doses and licensed degree of use for medical and cosmetic purposes to name a few.

Azzalure requires a higher volume of units per injection site than required with Botox to achieve similar results, most practitioners recommend that 3 units of Azzalure  can be used to 1 unit of Botox to achieve these results.

At the KT Training introduction to Botox course we teach clinicians to reconstitute BOTOX/VISTABEL

Botox (100 unit vials) with 2ML of bacteriostatic sodium chloride 0.9%
Vistabel (50 unit vials) with 1ML of bacteriostatic sodium chloride 0.9%botoxtraining

Various dilutions exist for Botox/Vistabel we find these dilutions straightforward for new injectors. The ease of transition would depend on whether your original training with Azzalure covered standard metric ML dilutions and units or the Speywood units.

 

For many experienced botulinum toxin injectors the transition can be very straightforward. If you are unsure of the transition from Azzalure to Botox I would recommend one of the  refresher Botox training courses which will provide a comprehensive knowledge of the Botox and Vistabel product plus hands-on injection time with patients provided to ensure a good level of confidence. The injectable breast implants Macrolane has been removed from the market due to fears that it may affect the readings for cancer breast screenings for patient. Q-Med who manufacture Restylane and Macrolane have made this decision.

Why was Macrolane for breast enhancements removed from the market?

Q-Med, said there were no safety issues with Macrolane.

It has also been recommended that women with Macrolane injections tell their doctors before they have a mammogram so that they can be screened more effectively.

The company said it hoped to re introduce the product at some point in the future after further study of the Macrolane breast injection.

How much do I charge my patients for the BOTOX® cosmetic treatments?

BOTOX® Treatments and Prices in the US

In the USA patients are charged for each unit of BOTOX® used for the treatment thus 25 units of BOTOX® used will cost the patient (direct cost times 10 times markup). In short if the cost of material used is $25 dollars, the retail price is approximately  $250.00.

What about the price of BOTOX® in the UK?

In the UK the price structure is different most cosmetic practices will price their botox treatments by area, with a slightly increased price for male patients who may require more BOTOX® units for the treatment.

A patient who requires 1 area treated would be a set price for example a treatment for the frown lines between the eyes, the glabellar area would use approximately 25-30 units of BOTOX® and prices may vary from £125-£200 plus depending on the patients sex, clinic location and clinician. Occasionally you will see special offers from some providers at a reduced price for certain areas.
